D.C. Gun Laws Still Unconstitutional

May 17, 2010 By Richard C. Young

Washington’s New Gun Rules Shift Constitutional Debate – Gary Fields, The Wall Street Journal
The politicians of Washington D.C. have shown that they will restrict gun ownership at the maximum possible level allowed by the Supreme Court until explicitly ordered to do otherwise. After the handgun ban in D.C. was struck down by the court, the number of homicides in the city has fallen to decade lows and citizens have eagerly attempted to exercise their second amendment rights. However, the process is onerous and seeks to actively use bureaucracy to impede (infringe) on the rights of gun owners. Soon D.C. will attempt to implement a law that forces gun manufacturers to I.D. every piece of ammunition shot through any new gun. It shouldn’t be hard to imagine that not only will this law make it hard on legal gun owners, it will be completely useless against criminals who will simply modify the machinery of the weapon to render the I.D. process useless. This new regimen of gun laws is not in line with the spirit of the Constitution’s second amendment. Look for the Supreme Court to intervene again on behalf of America’s gun owning citizens. – Dick Young

The Revenue Limits of Tax and Spend – David Ranson, The Wall Street Journal
David Ranson gets America’s current fiscal model just right with four Ds: debt, dependency, devaluation and default. The Obama administration has simply given up on telling Americans that the budget will be balanced someday, as the Bush and Clinton administrations did. Instead, the Obama regime will continue to just borrow money, and spend it before anyone has the chance to stop them. No matter how much the government attempts to jack up taxes (the Bush tax cuts will soon expire) the rate of revenues collected by the government compared to GDP will probably not breach 19%. So says the Hauser Law outlined here by Ranson. – Dick Young

Why Obama Chose Kagan – Terry Eastland, The Weekly Standard
President Obama made it clear in his State of the Union address that he completely disagreed with the Citizens United court ruling from the Supreme Court that allowed campaign contributions to flow from corporations to politicians. His effort to appoint Elena Kagan to the court is partially a response to that case. Kagan would surely have ruled the other way on the case, as she argued for the government in front of the court. President Obama and his regime wish to limit the ability of corporations of any kind to fight back against his onerous programs of tax and spend. Kagan is one more tool in his belt to achieve that. Any senator who votes to confirm Kagan should be considered for removal by his/her constituents. That goes double for those who also voted to confirm Sonia Sotomayor. The intentions of both of these radical left liberals are as plain as the nose on your face. Siding with either puts a senator in the Cass Sunstein camp of writing a new bill of rights that attempts to redistribute the nation’s wealth to those who didn’t earn it. – Dick Young

Who Gets the Gag? Elena Kagan’s First Amendment Problem – Gary Bauer, Human Events
Gary Bauer lays out a stunning piece that Elena Kagan wrote in the “interpretation” of the first Amendment. In her mind, the government should be allowed to limit speech when it is doing it for a good reason. In other words, when it makes Elena feel good, there is no such thing as free speech. And this woman has been nominated to the Supreme Court where she will be entrusted with protecting the Constitution? – Dick Young

Can Kagan Be Trusted to Defend the Constitution? – Ross Kaminsky, Human Events
Simple answer to Kaminsky’s question, no. – Dick Young

Good Cop, Bad Cop – Stephen Spruiell, National Review
A poorly worded Supreme Court decision has allowed the EPA to gain the power to regulate green house gas emissions. This is not something that should be left to bureaucrats. Congress needs to stand up and take control of the green house gas debate and not allow the EPA to destroy America’s economy from their Washington desk chairs. – Dick Young

Palin Joins Arizona Gov. to Defend Immigration Law – Jonathan Cooper, AP
Jan Brewer has made the right decision in her efforts to empower Arizona public safety officials to fill in the gaps that have been left by federal law enforcement incompetence. The security of the border is paramount to protecting the nation from terrorism. Illegal immigrants are a symptom of a broken border that must be fixed now. – Dick Young
